Terms of Service – Elira

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user") and Elira ("we", "us", "our"), operated by Hüseyin Talha Kadat as a sole proprietorship registered in the Republic of Türkiye.

By creating an account or clicking "Sign Up", you agree to these Terms. If you do not agree, do not use Elira.

1. Eligibility

You must be at least 13 years old to create an account and use Elira.

By using the service, you represent that:

  • You are at least the minimum required age in your jurisdiction.
  • You have the legal capacity to enter into these Terms.
  • You are not barred from receiving the service under applicable law.

If you are under 18, you should review these Terms with a parent or legal guardian.

2. Your Account

To use most features of Elira, you must register an account. You agree to:

  • Provide accurate, current, and complete information.
  • Keep your password confidential and secure.
  • Use a unique, strong password.
  • Notify us promptly at support@eliraapp.com if you suspect unauthorized access to your account.
  • Not share your account with others or allow other people to use it.
  • Be solely responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Service Description

Elira provides:

  • Vocabulary learning with Spaced Repetition System (SRS) flashcards
  • AI-generated content (translations, definitions, conjugations, example sentences, stories)
  • Quizzes and exercises (matching, listening, context, spelling)
  • Text-to-speech (TTS) audio playback
  • PDF reader with in-line word lookup
  • Personal collections, bookmarks, and learning statistics
  • Push notifications and progress reminders

We may add, modify, or remove features at any time without prior notice. We may also impose usage limits (e.g., daily word additions, story generation quotas) which may differ between free and paid plans.

4. Subscriptions, Payments, and Refunds

4.1 Plans

Elira offers a free tier with limited features and Premium subscriptions with expanded limits and additional features.

4.2 Payment Processors

Premium subscriptions are processed by:

  • Apple App Store (for iOS in-app purchases)
  • Google Play (for Android in-app purchases)
  • Paddle (for purchases on eliraapp.com; Paddle acts as the merchant of record and handles billing, taxes, and invoicing)

Pricing is shown in your local currency where supported. Applicable taxes will be added at checkout.

4.3 Auto-Renewal (Apple App Store and Google Play)

Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. The account will be charged for renewal within 24 hours prior to the end of the current period. Subscriptions may be managed and auto-renewal turned off in your Account Settings after purchase.

For Apple subscriptions, manage at: Settings → [your name] → Subscriptions For Google Play subscriptions, manage at: Google Play app → Profile → Payments & subscriptions → Subscriptions For Paddle subscriptions, you will receive a self-service link in your purchase confirmation email.

4.4 Refunds

  • Apple App Store and Google Play purchases are governed by the refund policies of the respective platform. Submit refund requests directly to Apple or Google.
  • Paddle (web) purchases – contact support@eliraapp.com within 14 days for refund consideration.

4.5 Right of Withdrawal (Türkiye)

If you are a consumer resident in Türkiye, you have a 14-day right of withdrawal for digital content under Law No. 6502 (Tüketicinin Korunması Hakkında Kanun), provided you have not yet started using the digital content. Once you begin using the Premium features, the right of withdrawal expires.

4.6 Free Trials and Promotions

If we offer a free trial, you may be required to provide payment information at sign-up. Unless you cancel before the trial ends, you will be automatically charged for the subscription. Promotions are limited to one per account unless stated otherwise.

4.7 Price Changes

We may change subscription prices. For active subscriptions, price changes will only take effect at the start of the next billing period and after we notify you with reasonable advance notice.

5. Acceptable Use

You agree NOT to:

  • Use Elira for any illegal, harmful, or fraudulent purpose
  • Submit content that is unlawful, defamatory, hateful, sexually explicit, or violent
  • Submit content that infringes the intellectual property or privacy rights of others
  • Attempt to gain unauthorized access to other accounts, our servers, or other users' data
  • Reverse engineer, decompile, or attempt to derive the source code of the app
  • Use bots, scrapers, or any automated tools to access the service
  • Abuse AI features (e.g., excessive automated requests, prompt injection attempts to bypass safety measures, generating harmful content)
  • Resell, sublicense, or commercially redistribute access to the service
  • Share or publish content generated by the service in a way that misrepresents it as your own original work for commercial gain
  • Circumvent usage limits, quotas, or paywalls
  • Interfere with or disrupt the integrity or performance of the service
  • Use the service to send spam or unsolicited communication
  • Use the service if you are under the minimum age required by Section 1

We may suspend or terminate your account for violations.

6. Your Content and License to Us

You retain all rights to the content you create or submit (vocabulary, sentences, notes).

You grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, display, and process your content solely for the purpose of providing, securing, and improving the service for you (e.g., AI processing, syncing across your devices, generating responses, backing up data).

This license:

  • Lasts only as long as your content is stored on our servers
  • Ends when you delete the content or your account
  • Does not include the right to use your content to train third-party AI models
  • Does not include the right to sell, rent, or share your content with advertisers
  • Does not include the right to use your content for marketing without your separate consent

7. AI Content – Disclaimer

Elira uses third-party AI providers (such as Anthropic and Google Gemini) to generate translations, definitions, examples, conjugations, and stories.

AI-generated content is provided for educational language-learning purposes only. It may be:

  • Inaccurate, incomplete, or out of date
  • Linguistically incorrect or contextually inappropriate
  • Inconsistent across requests
  • Reflective of biases present in the training data

You should:

  • Verify important information from authoritative sources before relying on it
  • Not rely on AI output for medical, legal, financial, or other professional advice
  • Not treat AI output as a substitute for guidance from qualified instructors

You use AI-generated content at your own risk. We are not responsible for actions you take based on AI-generated content.

8. Third-Party Services

Elira relies on the following third-party services to operate. Each is governed by its own terms and privacy policy:

  • Google LLC – Firebase Authentication, Firebase Cloud Messaging, Google Gemini API, Google Cloud Text-to-Speech
  • Anthropic PBC – Claude API (AI processing)
  • ElevenLabs – text-to-speech
  • Cloudflare Inc. – cloud storage (R2)
  • Resend Inc. – transactional email delivery
  • RevenueCat Inc. – mobile subscription management
  • Paddle.com Market Ltd. – web payment processing (merchant of record)
  • Apple Inc. / Google LLC – mobile in-app purchases via the App Store and Google Play

We are not responsible for any acts, omissions, or content of third-party services. Disruptions or changes in their services may affect Elira.

9. Intellectual Property

All rights in the Elira app, website, branding, design, code, and content created by us are owned by Hüseyin Talha Kadat or our licensors and are protected by Turkish and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use Elira for your personal, non-commercial educational use, subject to these Terms.

You may not:

  • Copy, modify, or distribute the app or website
  • Remove or obscure any proprietary notices
  • Use Elira branding, logos, or names without written permission

10. Termination

10.1 Termination by You

You may stop using Elira and delete your account at any time:

10.2 Termination by Us

We may suspend or terminate your account immediately, with or without notice, if:

  • You materially violate these Terms or our Privacy Policy
  • We are required to do so by law
  • The continued provision of the service to you is no longer commercially viable
  • Suspected fraud, security risk, or abuse

We may also remove or restrict access to specific content (e.g., user-submitted sentences, words, or generated stories) without terminating your entire account, where the content violates these Terms or applicable law.

10.3 Effect of Termination

Upon termination, your right to use the service ends. Sections that by their nature should survive termination (e.g., License to Us, AI Disclaimer, Limitation of Liability, Governing Law) will continue to apply.

Active paid subscriptions are not refundable on termination, except where required by law (see Section 4.4–4.5).

11. Service Availability

We strive to keep Elira available and reliable, but we do not guarantee uninterrupted access. We may suspend the service for maintenance, updates, or technical reasons without prior notice, and we may also experience downtime caused by third-party providers, network failures, or other events beyond our control.

We are not liable for any losses or inconvenience resulting from temporary unavailability of the service. Where reasonably possible, we will announce planned maintenance in advance via in-app notification or our website.

12. "AS IS" Disclaimer

To the maximum extent permitted by applicable law, Elira is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

We do not warrant that:

  • The service will meet your specific requirements
  • The service will be uninterrupted, timely, secure, or error-free
  • AI-generated content will be accurate or fit for any particular purpose
  • Defects will be corrected

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, loss of opportunity, or loss of goodwill, even if advised of the possibility.
  • Our total aggregate liability for any claim arising out of or related to these Terms or your use of Elira shall not exceed:
    • The total amount you paid us during the twelve (12) months preceding the event giving rise to the claim, or
    • USD 50 (or its equivalent in your local currency), whichever is greater.

This limitation applies to the fullest extent permitted by applicable law and does not apply to liability that cannot be limited (e.g., gross negligence, willful misconduct, or statutory consumer rights).

14. Notices and Updates to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision.

  • Material changes (e.g., changes affecting your rights, subscription terms, or governing law) will be notified to you via in-app notification and/or email at least 30 days before they take effect.
  • Non-material changes (e.g., typo fixes, clarifications) take effect upon posting.

Your continued use of Elira after a change indicates your acceptance of the revised Terms. If you do not agree, you must stop using Elira and may delete your account.

15. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, internet or power outages, third-party service failures, pandemics, or industrial disputes.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified. The remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Elira and supersede all prior agreements, communications, and proposals (whether written or oral) on the subject.

18. Assignment

You may not assign or transfer your account or any rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, with notice to you.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved exclusively by the İstanbul Anadolu Courts and Enforcement Offices (İstanbul Anadolu Mahkemeleri ve İcra Daireleri), except where mandatory consumer protection law in your jurisdiction grants you the right to bring an action in your local courts.

Nothing in this section limits your rights under mandatory consumer protection laws. If you are a consumer resident in the European Union or another jurisdiction with mandatory consumer protections, those statutory rights cannot be excluded or limited by these Terms.
